Winegrower may not operate wine vending machines in her own garden - Rhineland-Palatinate Higher Administrative Court issues clear ruling

At first glance, the idea of setting up a wine vending machine in your own garden sounds like a practical and charming way to sell wine. However, a recent ruling by the Rhineland-Palatinate Higher Administrative Court (OVG) shows that it is not that simple. In a case that is likely to interest many winegrowers and small businesses, it was decided that setting up a wine vending machine in a private garden violates the Youth Protection Act. We explain in detail why this decision is correct and what needs to be considered.

Why the wine machine is not allowed in the garden

The Rhineland-Palatinate Higher Administrative Court has clearly ruled that the wine vending machine of a winegrower may not be operated in her private garden - and for a very simple reason: the vending machine was located on a residential property and not in a commercially used area. According to the Youth Protection Act, it is forbidden in Germany to offer alcoholic drinks in public via vending machines - unless the machine is located in a commercial area and ensures that children and young people do not have access to the drinks. However, as this wine vending machine was installed in a private garden, it is in breach of these regulations.

Cigarette vending machines are allowed to do more - why the difference is justified

You may be thinking: "But cigarette vending machines are also available in public areas, why do different rules apply there?" In fact, different regulations apply to cigarette vending machines. The Youth Protection Act allows cigarette vending machines to be set up as long as it is ensured that minors cannot take cigarettes. However, the installation of wine vending machines is subject to stricter regulations. The difference lies in the different health effects of alcohol and nicotine. While both are harmful to health in the long term, alcohol has a much more immediate effect on perception, responsiveness and motor skills. The disinhibiting effect of alcohol in particular can lead to dangerous misconduct, which is not to be expected in this form with cigarettes.

What does this mean for entrepreneurs and winegrowers?

The ruling clearly shows that there are clear rules for entrepreneurs who want to sell alcoholic beverages that must be observed. Even if the idea of setting up a vending machine in your own garden or on your own property may seem tempting, it is important to understand the legal provisions for the protection of minors. If you want to sell alcohol as a winegrower or small business owner, you must make sure that the vending machine is set up in a commercially used space - and that technical safety precautions are taken to prevent minors from accessing it.

The OVG's ruling is another example of how legislators and courts are strictly monitoring the availability of alcohol in public spaces. The decision not only protects the health of young people, but also ensures that business practices are in line with legal requirements. So if you are a winemaker or business owner interested in operating a wine vending machine, you should inform yourself well to prevent legal problems.

Youth protection comes first - and that's a good thing

The ruling by the Rhineland-Palatinate Higher Administrative Court makes it clear that protecting children and young people from the dangers of alcohol is a high priority in society. For business owners, this means that they must carefully examine how and where they sell alcoholic beverages in order not to violate the Youth Protection Act. Those who adhere to these rules can avoid legal problems and at the same time help to combat youth alcoholism.
