Banks collected too much for years - now the BGH is paying customers back

For years, many banks and savings banks have been quietly increasing their fees - often without the clear consent of their customers. Particularly brazen: Anyone who did not actively object was supposed to have agreed automatically. A trick that is likely to have cost millions. But now a ruling by the Federal Court of Justice (BGH) provides clarity - and a deadline that you should be aware of!

According to the latest ruling, customers can reclaim overpaid fees retroactively for three years. Important: The period begins at the end of the year in which the fees were charged - not with the Federal Court of Justice ruling of 2021, which overturned this practice.

The trick with the "fiction of consent"

The central clause in question sounds harmless - but it had far-reaching consequences: many terms and conditions stated that customers automatically agreed to them if they did not actively object. Among other things, this concerned fee increases, e.g. for account management or card use. So anyone who didn't read the small print carefully often paid more - without realizing it.

The Federal Association of Consumer Organizations had therefore filed a lawsuit against Berliner Sparkasse. The aim was to enforce a longer period for reclaims - from the point at which customers became aware that the clause was invalid, i.e. from 2021 at the earliest. However, the BGH has now ruled differently.

BGH: Customers could have sued earlier

The Federal Court of Justice remains firm: ignorance does not protect against the statute of limitations. If you want to get your money back, you can only do so for the last three years from the end of the respective year. In concrete terms, this means that fees from 2021 expire at the end of 2024, so if you want to get money back from this year, you need to hurry.

The reasoning: The legal situation was not uncertain even before the BGH ruling in 2021. So anyone who had actively informed themselves could have filed a lawsuit beforehand. Is that realistic? That's debatable - but legally, the decision is clear.

A deadline that nobody knows about only protects the banks

This decision is a Pyrrhic victory for consumers. Yes, you can reclaim money - but only if you were quick enough or take action now. The idea that bank customers should regularly struggle through the small print or even sue at an early stage is unrealistic.

The banks have systematically cashed in - and are now getting off lightly thanks to the statute of limitations. If you want your money back, there's no time to lose. Now is payday - but only for those who act!
