Away with the stigma: court overturns 3-year rule for negative entries

It's a judgment that hits like a thunderbolt: the Cologne Higher Regional Court has ruled that completed negative entries in Schufa may not only disappear after three years - but immediately! This could turn Schufa's entire business model on its head.

Previously, anyone who was late with a payment had to live with this blemish on their record for three years - even if the debt had long since been settled. This had a negative effect on the so-called "score" - and made loans, cell phone contracts or installment purchases a challenge. Now the court says: No more!

And that's not all: anyone who continues to be stored despite having paid their debt may even be entitled to at least 500 euros in compensation.

Why the ruling is a small revolution

Previously, Schufa referred to its own code of conduct, which was introduced in 2018. This stipulated that completed entries could remain stored for three years. The argument: banks, retailers and mobile phone providers should receive a comprehensive picture of payment behavior.

The Cologne Higher Regional Court takes a different view: those who have paid their debts should no longer be pilloried. Immediate deletion is therefore not only fair, but also technically feasible.

Although the ruling is not yet legally binding, it is already putting Schufa under a lot of pressure.

What does this mean for consumers?

Clearly, this is a glimmer of hope for millions of people. Anyone who has got into financial difficulties but has sorted out their affairs can get back on their feet more quickly in future - without being stuck in the digital credit drawer for three years.

Of course, there are also critical voices. Banks and retailers fear that they will take higher risks without this information - and end up having to raise interest rates or prices. BILD quotes experts who speak of "higher costs for consumers".

But honestly, is it fair to punish people for years even though they have long since paid for everything?

Schufa is finally grounded!

Schufa has too much power - and too little control. The fact that a private company intervenes so deeply in all our lives was overdue for closer legal scrutiny.

The ruling from Cologne is a strong signal: transparency and fairness belong not only on paper, but also in the databases. Anyone who has corrected their mistakes deserves a second chance - without a digital backpack.

Schufa needs to rethink. Not everything that is technically possible is also morally justifiable. We hope that the Federal Court of Justice will continue along this path - and that the principle of proportionality will finally be applied to scoring.
