What happens when customers register for an exclusive Christmas party but simply don't show up? A restaurant in Munich recently provided the answer: A hefty fine of 2500 euros. And all because a company didn't keep its reservation. The tables were set, the food prepared, but the guests didn't show up. The landlord didn't take this lying down and went to court.

Why the court ruled in favor of the restaurant

The company from the Munich area had ordered a festive table for 15 people in an upscale restaurant in the Schlachthof district. The agreement: a menu for 125 euros per person, plus drinks. But when the big evening arrived, the guests were not there. There was neither a cancellation nor an apology. The restaurant was stuck with the costs and filed a lawsuit.

The landlord argued that the prepared food and the reserved seats were no longer available for other guests. The court ruled that a valid contract existed, even if the company did not confirm the reservation in writing. A simple "We would like to confirm the reservation" in an email was sufficient to form a binding contract. And this is exactly where the court saw the damage for the restaurant. The court awarded the landlord 2,500 euros in damages, as the food and drinks ordered for the evening could no longer be used.

Why this case is so important

This ruling shows the consequences that can arise if customers do not keep their reservations without canceling them. A "no-show" can be very expensive for a restaurant, especially for exclusive events or menus that have been elaborately prepared. But companies and customers should also be aware that such incidents can have legal consequences. Such behavior not only costs money, but also trust.

In this case, the company had to pay a large fine, but the effects of such behavior can also have long-term consequences for the business relationship between customers and service providers. Simple rules such as canceling in good time can prevent a lot of trouble and costs.

Is a fine of this amount really fair?

"2500 euros fine for a no-show at a Christmas party - is that fair?" the reader may ask. Of course, a contract was concluded and the damage was real for the restaurant. But it also shows how little trust some companies have in their customers and how quickly a simple incident can lead to a legal conflict. Shouldn't there be more understanding for such "missteps"? The law is clear, but in such cases, alternative solutions such as an apology and an agreement to mitigate the damage could perhaps be more sensible and humane. But: the law knows no holidays!
