From tester to defendant: Stiftung Warentest under pressure

What actually began as consumer protection could become an expensive own goal for Stiftung Warentest. For the first time in its history, the well-known testing institution has been ordered to pay damages by the Frankfurt Regional Court - and this could cost it millions. The background to this is a faulty test of a smoke detector from Pyrexx, which was wrongly rated as "inadequate". A blow for Pyrexx - and a warning signal for all those who previously trusted product tests blindly.

The Frankfurt judges found clear words: the test was not only wrong, but "simply indefensible". Particularly piquant: Stiftung Warentest had relied on a Belgian testing institute and hardly checked the test conditions. A tactic that is now taking bitter revenge.

The fatal mistake: smoke too thin, alarm too late

What exactly went wrong? The prescribed smoke density was not reached in the test fires - the Pyrexx smoke detector was therefore simply unable to detect anything. This was revealed by test protocols that Stiftung Warentest only had to disclose under pressure from a court. A bitter setback for the testers, who otherwise advertise with the trust of millions of consumers.

Because the tests were carried out on the wrong basis, the damning verdict of "inadequate" was not justified. The result: serious damage to Pyrexx's image and a drop in sales of around 30 percent. No wonder the company is now claiming over 7.7 million euros in damages.

Responsibility knows no excuses: Why Stiftung Warentest is liable

Stiftung Warentest argued that the errors had occurred at the Belgian testing institute. However, the Frankfurt Regional Court did not accept this excuse: Anyone who commissions third-party experts remains responsible - period. The judges made it clear that the foundation has a special duty of care due to its enormous influence on consumer decisions.

In short: Stiftung Warentest cannot simply hide behind a testing institute. If something goes wrong in a test, the foundation has to answer for it - including all the financial consequences.

Scratches on the myth Stiftung Warentest

What has happened here scratches the myth of Stiftung Warentest. The institution has built up trust for decades - and rightly so. But anyone who enjoys this trust must not take the lazy route and shirk their responsibilities. "Checking instead of blindly trusting" should be the new motto. After all, product tests are not a playground for credulity - they decide on livelihoods.

The fact that Stiftung Warentest has lodged an appeal against the ruling shows: The seriousness of the situation has not yet been fully grasped. Instead of investing energy in further lawsuits, a radical rethink would be better: stricter internal controls, full transparency - and a clear apology to all those who have suffered unjustly from false test results.

To put it plainly: trust is not for life - you have to earn it every day.
