Unfortunate stranding - sanctions with far-reaching consequences

On October 27, 2022, just a few days after the Russian invasion of Ukraine, a jet from the Russian airline Aeroflot lands at Franz-Josef-Strauss Airport in Munich. After Germany imposed an airspace ban on Russian aircraft as part of the international sanctions against Russia, the plane was no longer allowed to take off. As a result, the plane was "stranded" at Munich Airport.

Expensive parking meter

An inquiry by Bayerischer Rundfunk revealed that the plane had already taken off again for the Czech Republic in June 2024, after several years of standing still. But how did this happen? It is now clear that it does not belong to Aeroflot at all, but to a Chinese leasing company. This company has borne the immense costs for the long downtime at Munich Airport and had the aircraft expensively restored. In the future, the aircraft will probably come to Canada on a long-term basis.

Our assessment of the case

The legal situation is anything but clear. Who is responsible for the immense costs? Munich Airport or the Russian airline Aeroflot? The sanctions create a legal gray area in which both parties must navigate. There are no easy answers and the solution to this dilemma could be a long time coming.

This example shows impressively how international politics and local actors are intertwined. The sanctions against Russia have far-reaching and often unexpected consequences. For Munich Airport and Aeroflot, this is a financial nightmare; for us, it is an exciting legal case. We can only hope that this story will soon come to an end and that we can all learn from it. Because one thing is certain: in today's global world, we are all connected, whether we like it or not.
