The use of TikTok and other social media has become an integral part of many people's everyday lives - including trainees. But what happens when these platforms are used during working hours to provide humorous insights into everyday training life? Two trainees from Hesse have now had to face the consequences after their satirical videos on TikTok caused a huge uproar. The consequences: dismissal without notice.

A video for the public, a job for the bin

The two trainees had made videos during their working hours in which they satirically portrayed their everyday working lives. One video showed a trainee repeatedly ignoring customer calls, in another video she even fell asleep during working hours. Another trainee portrayed unfriendly customer conversations in a video, completely dressed in the retail store's work clothes.

What appeared to the trainees to be a humorous portrayal of their training was perceived as unprofessional and disrespectful by their employers. The videos reached many viewers on TikTok and made headlines - but not in the desired positive light. The damage these satirical clips did to the company was ultimately too great for employers to ignore.

Humor yes, but please with respect - the limits of what is allowed

The two trainees defended themselves by saying that their videos were only intended as comedy and satire. But this explanation could not prevent their dismissal without notice. After all, what was intended as harmless fun can quickly become a serious breach of professional duties in the eyes of employers.

It was particularly problematic that filming during working hours not only violated the employment contract, but also the personal rights of colleagues and data protection regulations. Sensitive customer data was even visible in one of the videos - a serious breach that could have legal consequences.

The legal pitfalls of social media in the workplace

The case from Hesse shows how important it is to understand the legal framework for the use of social media in everyday working life. Even if humor and creativity are encouraged in training, trainees should always keep an eye on the boundary between private fun and professional responsibility. Safeguarding the company's reputation and data protection in particular must be a top priority. Anyone who shows their face on social media should always bear in mind the possible consequences - for themselves and for their employer.

Social media in the workplace: how far can employers go?

It is exciting to see how the topic of social media is increasingly becoming the focus of legal attention. On the one hand, it is understandable that companies want to protect their reputation. On the other hand, the question arises as to how far employers can encroach on the privacy of their employees. A certain amount of light-heartedness and humor in everyday working life could contribute to a better working atmosphere. But there is a fine line between creative development and legal problems. It is to be hoped that future cases will also lead to a more balanced approach to social media in the workplace. After all, training should not only be about learning specialist knowledge, but also about understanding responsibility - both online and offline.
