The days when we had to adhere to fixed opening hours are increasingly becoming a thing of the past. The latest ruling by the Münster Higher Administrative Court (OVG) is a decisive turning point. A vending machine kiosk in Bonn is allowed to keep its doors - or rather, its vending machines - open around the clock on Sundays and public holidays. What is a vending machine kiosk?

Imagine entering a small store - but instead of friendly staff, you find vending machines. There are 15 of them, each offering a selection of 40 to 50 different items. No people behind the counter, no cashiers - everything runs fully automatically. This type of kiosk is known as a vending machine kiosk. And it is precisely this type of kiosk that is now causing a stir, as the Higher Administrative Court has ruled that this type of vending machine may remain open on public holidays and Sundays.

Why did the court have to decide?

The city of Bonn had prohibited the operator of the vending machine kiosk from opening on Sundays and public holidays. However, the OVG Münster overturned this decision. The reason? According to the court, a vending machine kiosk that is operated without staff does not fall under the North Rhine-Westphalia Shop Opening Act (LÖG). While the law actually stipulates that stores must remain closed on Sundays and public holidays, there are exceptions - and vending machine kiosks are not classed as traditional "stores" as they do not require employees to operate.

What impact will the ruling have?

For many consumers, the ruling means one thing above all: more flexibility and a larger selection of goods that are available around the clock. Especially for people with irregular working hours or for spontaneous shopping on public holidays, the vending machine kiosk is a convenient solution. For store owners, this opens up a new area of business that no longer requires traditional opening hours and therefore remains competitive.

However, the ruling also raises the question of the extent to which increasing automation will put further pressure on traditional retail. Will more and more stores be replaced by vending machines in the future? The trend is already moving in this direction.

The verdict as a trendsetter?

The ruling by the OVG Münster is more than just a legal detail. It reflects the trend that more and more business models are challenging traditional structures. What seemed unthinkable just a few years ago is now a reality: vending machine kiosks are allowed to open around the clock. A blessing for many, a challenge for others.

The ruling has a lively tendency - in the right direction! The legal provisions often lag behind reality, and this sends a clear signal that automation and professional freedom belong together. Only time will tell whether it will ultimately overturn traditional business. But the fact is that those who fail to adapt could soon be overtaken by technology.
